Terms & Conditions

  1. The following terms and conditions apply exclusively to this Promotional Competition (“Competition”). Participation in the Competition constitutes your acceptance of these terms and conditions. By entering the Competition participants agree to have read, understood, and accepted the same.


  1. The promoter is Ekhamanzi Springs (Pty) Ltd t/a aQuellé (“the Promoter”).


  1. The name of this competition is “aQuellé Favour the Flavour


  1. This competition opens at 00h00 on 6 February 2023 and ends at 23h59 on 30 April 2023. Any entries received after the closing date will not be accepted.


  1. The competition is open to all South African citizens and residents in possession of a valid identity document, passport or document of proof of South African residency, and excludes any person who is a director, member, partner, employee , agent or consultant for the Promoter or any other person who directly or indirectly controls or is controlled by the Promoter, such as its sponsors, their respective advertising and promotional agencies, media and PR agencies, as well as immediate family members, consultants, directors and associates of such organisations.


  1. Participants must enter this competition in their personal capacity only. No close corporations, partnerships or any other legal entity may participate.  Any participant under the age of 18 (eighteen) years must be fully assisted by his/her guardian, who approves of and consents to the participant’s participation in the competition and the participant’s receipt/possession of the prize.


  1. Should a winner/s choose not to accept the prize he/she will forfeit the prize and a new winner will be drawn in accordance with the rules of the competition.


  1. By entering this competition, you acknowledge that, should you be a winner, you may be required to provide proof of identification and any other such documentation as may be required by the Promoter to comply with mandatory requirements as may be necessary. A prize will only be awarded once the verification process has been satisfactorily and timeously completed and confirmed according to the rules of this competition. By entering the competition, entrants accept that the competition will be managed in accordance with the provisions of the Consumer Protection Act, 68 of 2008.


  1. How to enter the aQuellé Favour the Flavour competition:


  • Collect all 3 limited edition caps with these messages:

  • Take a photo of the 3 caps together and send it via WhatsApp to +27 32 492 0555.


  1. Standard data rates may apply.


  1. The Promoters & all agents may not be held liable for any technical failures affecting the participation and/or Prize redemption process, and participants to the competition are responsible for ensuring their personal details are entered correctly.


  1. Winners stand a chance to win one of 3 prizes from a selection of prizes: a R100 000 cash prize, aQuellé product for a year or an aQuellé hamper.


  1. Participants may enter multiple times but will only be eligible to win one prize during the entire Competition Period.


  1. All eligible winners will be chosen by an audited random draw from the valid entries received.


  1. The prizes are:


  • 1x R100 000 cash prize, issued within 4 weeks after the end of the competition.


  • 12x aQuellé product for one year (365 bottles).


  • 1 of 168 summer hampers


  1. Prize winners will be notified telephonically as per the details submitted on the competition WhatsApp chat and will be required to verify their details.


  1. The Promoter will endeavour to contact an eligible winner telephonically within a week (7 Days) of drawing the prize using the phone number submitted to the competition. If an eligible winner cannot be contacted, the chance to win a prize will be forfeited and a backup eligible winner will be drawn, and the same terms and conditions shall apply.


  1. Prizes are not exchangeable nor transferable under any circumstances.


  1. The Promoters may require the winners (at no fee) to be identified, photographed and the photograph or related article published in printed media, radio, television and social media, when accepting their prizes and/or after receiving their prize.


  1. Should this become necessary, the winners may be required to sign a letter of consent and the Promoters shall have the right to use any photographs of any of the winners in perpetuity.


  1. By participating in this competition, participants agree to receive future marketing material from the brand/s on promotion. However, the participant has the right to unsubscribe from receiving marketing material or request the Promoter to delete their information by contacting the Promoter at [email protected]


  1. Any personal data submitted will be used solely in accordance with current South African data protection legislation and the Promoter’s privacy policy, which can be viewed here: aquelle.co.za


  1. By participating in this Competition, you consent to the Promoter sharing your personal data with reward partners, agents and affiliates for purposes related to the operation of the Competition, including (without limitation) fulfilling of rewards issued to Participants. “Affiliates” means, any entity controlling, controlled by or under common control with the Promoter and suppliers for the purposes of this Competition.


  1. The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected including, without limitation, the manipulation of code or otherwise falsifying data. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions and competition rules.


  1. Any attempt to use multiple cell phone numbers or other tactics to enter more than the stated limit may result in disqualification and all associated entries and/or votes will be void. No person can use another person’s cell phone number for Competition entry purposes. This rule has been implemented in order to avoid fraud and possible litigation between the mobile phone owner and the Competition entrant.


  1. The Promoters reserves the right at any time, without notice, to amend, modify, or change these rules and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary and all entrants agree to waive any rights that they may have in terms of this competition and acknowledge that they will have no recourse against the Promoter or its agents or distributors.


  1. Neither the Promoter, their agents, associated companies, nor any directors, officers, or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential, or otherwise arising from any cause whatsoever, which may be suffered by the participants in connection with this competition or the use of the prizes. All risks and ownership of the prizes shall pass to the winners on transfer/delivery thereof.


  1. The eligible prize winners may be required to sign an indemnity and failure to do so will result in the prize being forfeited.


  1. The Promoter shall not be liable for any costs incurred by the entrants and eligible winners for entering the competition but will cover the cost of delivering prizes to winners.


  1. In the event of a dispute, the decision of the Promoters will be final and binding on all aspects of this competition and no correspondence will be entered into. These terms and conditions are not intended in any way to unlawfully restrict, limit, or avoid any rights or obligations created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (‘CPA’)


  1. Participation in the competition constitutes acceptance of the competition rules and participants agree to abide by the rules.
